Welcome to PureCare Pharmacy. These Terms & Conditions outline the rules for using our pharmacy services and website. By accessing or using our services, you accept these terms. If you disagree with any part, please do not use our services.

General Terms

These Terms & Conditions govern your use of PureCare Pharmacy services and website, located at 455 School St #48, Tomball, TX 77375.
By using our pharmacy services or website, you agree to comply with these terms and all applicable federal and Texas laws and regulations.
We reserve the right to refuse service to anyone who violates these terms or engages in fraudulent activity.
Prescription services are available only to patients with valid prescriptions from licensed healthcare providers.
Our Privacy Policy explains how we handle personal and health information and is incorporated by reference.

Website & Online Requests

Our website provides information and online tools to request contact, prescription refills, or prescription transfers.
Submitting an online form is a request only — it does not create a filled prescription, guarantee stock, insurance coverage, or same-day dispensing until our pharmacists verify the request, prescription, and eligibility.
You agree to provide accurate information on all forms. False or incomplete information may delay or prevent service.
Website content (articles, FAQs, and general information) is for educational purposes and is not a substitute for professional medical advice.
You may not misuse the site, attempt unauthorized access, scrape content for commercial use, or submit spam or abusive messages.

Prescription Services

Valid prescription required: All prescription medications require a valid prescription from a licensed healthcare provider.
Prescription verification: We verify prescriptions with prescribers as required by Texas law and professional standards.
Controlled substances: Dispensing of controlled substances follows DEA and Texas DPS regulations.
Prescription transfers: We accept prescription transfers from other pharmacies in accordance with state and federal laws.
Refills: Refills are processed based on prescriber authorization and regulatory requirements.
Compounding: Compounded medications are prepared for individual patients pursuant to a valid prescription and are not commercially interchangeable with manufactured products.

Delivery

We offer free local delivery for patients in Tomball and nearby areas, subject to address confirmation and pharmacy capacity.
Delivery timing is typically same day or next business day during our regular hours; it is not guaranteed for every address or order.
Someone must be available to receive medications when delivered, or we may need to reschedule.
Controlled substances and certain medications may have additional delivery or pickup requirements under law or pharmacy policy.
Call us to confirm that we deliver to your address before relying on delivery for a specific prescription.

Payment and Insurance

We work with most major insurance plans, including Medicare and Medicaid. Coverage depends on your specific plan — we are happy to verify.
Co-payments and deductibles are due at the time of service.
For non-covered medications, payment is required before dispensing.
Insurance claim disputes should be directed to your insurance provider; we can help with documentation when appropriate.
Cash pricing may be available for patients without insurance coverage; ask our staff for current options.

Product Returns and Refunds

Prescription medications cannot be returned once dispensed, per federal law.
Over-the-counter items may be returnable with receipt according to our current store policy — ask our staff for details before purchase if returns matter to you.
Compounded medications are non-returnable as they are customized for individual patients.
Defective products or incorrectly filled prescriptions will be addressed promptly; contact us immediately.
Report any medication errors or concerns to our pharmacy staff as soon as possible.

Regular pharmacy hours: Monday – Friday 9:00 AM – 5:00 PM
Closed on weekends and major holidays
Emergency prescription needs should be directed to the nearest 24-hour pharmacy
Prescription processing times may vary based on insurance verification and medication availability
Special-order medications may require additional processing time

Patient Responsibilities

As a patient of PureCare Pharmacy, you are responsible for:

Providing accurate and complete health information
Informing us of all medications, supplements, and allergies
Following medication instructions and asking questions when unclear
Keeping prescriptions secure and out of reach of unauthorized persons
Properly disposing of unused or expired medications

Limitation of Liability

To the fullest extent permitted by law, PureCare Pharmacy is not responsible for delays caused by manufacturers, wholesalers, insurers, or other third parties; for outcomes that result from incomplete or inaccurate information you provide; or for website outages beyond our reasonable control. Nothing in these terms limits liability that cannot be limited under Texas or federal law, including for pharmacy professional negligence where such limitation is prohibited.

Prohibited Activities

We prohibit fraudulent prescriptions, doctor shopping, false identification, abusive behavior toward staff, or attempting to obtain medications for illegal purposes. Violation may result in refusal of service and, when required, reporting to appropriate authorities.

Governing Law & Disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Please contact pharmacy management first to resolve concerns. Pharmacy practice complaints may also be directed to the Texas State Board of Pharmacy. To the extent a court dispute arises and is not otherwise resolved, venue lies in the state or federal courts serving Harris County, Texas, unless applicable law requires otherwise.

Using our services or website constitutes agreement to these terms.
